The processing of personal data of the owner, including sensitive personal data collected, and unless the owner provides otherwise through the means described in this Privacy Notice, is intended to be used for consulting, hiring, benefits, market research, notifications about changes in conditions, to meet legal requirements of competent authorities, analysis of employee candidates and employees of MAINBRAIN's affiliated and subsidiary companies, to fulfill labor obligations with its employees, to request and provide employment references to third parties of employee candidates or former employees of MAINBRAIN or affiliated companies or, the analysis, research, socioeconomic studies and statistical reports of employees or employee candidates at MAINBRAIN or affiliated companies. The purposes previously described gave rise to and are necessary for the legal relationship with MAINBRAIN and/or its affiliated and subsidiary companies.
Likewise, MAINBRAIN may use your personal data for the design, development, analysis, advertising, promotion of services, surveys, etc. The owner has a period of 5 (five) business days after the date on which his/her personal data was obtained, to, if applicable, state to the Institute or affiliated companies his/her refusal to process the data for purposes that are not necessary, nor did they give rise to the legal relationship with the person responsible.
The personal data of the employee or candidate will be kept strictly confidential, in accordance with the administrative, technical and physical security measures that the Institute implements for this purpose in its security policies and procedures.
In order to protect personal data, privacy and the trust of our clients, the owner of personal data may at any time limit the use or disclosure of their personal data, as well as deny or revoke authorization for its processing, by exercising the rights of access, rectification, cancellation or opposition provided for by law.
To exercise the rights of access and rectification, the employee must send a written communication, attaching the documents that support the rectification, to the Human Resources department. Candidates for employment may exercise the aforementioned rights through the email account [email protected].
Regarding the exercise of the right of cancellation and opposition, or to exercise revocation or denial, the employee or candidate must submit the request by email through the email account [email protected].
The application must contain and be accompanied by the following:
a) The name of the owner and address or other means to communicate the response to his/her request;
b) Documents proving the identity or, where applicable, the legal representation of the holder;
c) A clear and precise description of the personal data in respect of which you seek to exercise any of the aforementioned rights, and
d) Any other element or document that facilitates the location of personal data.
The controller will communicate the response to the data subject's request through the contact method provided, within a maximum period of twenty days, counting from the date on which the request was received. The period may be extended once for an equal period, provided that the circumstances of the case justify it.
MAINBRAIN may transfer and/or forward data to:
1. The competent authorities for compliance with the legal obligations arising from the contractual relationship between the owner of personal data (employee) and the controller.
2. MAINBRAIN affiliated and subsidiary companies.
3. Third party service providers for compliance with legal obligations acquired by MAINBRAIN or any of its affiliated and subsidiary companies.
4. Third party service providers for research purposes, data analysis, statistical reporting, promotions, benefits and services related to employees or employee candidates of MAINBRAIN and its affiliated and subsidiary companies.
5. Business partners with whom MAINBRAIN or any of its affiliated or subsidiary companies, carries out agreements or contracts focused on the development of new services for employees.
6. Third parties requesting employment references from former employees of MAINBRAIN or affiliated or subsidiary companies
7. Third parties arising from a corporate restructuring, including, merger, consolidation, sale, liquidation or transfer of assets.
8. Other transmissions provided for in the aforementioned Law and its Regulations.

The owner of personal data who submits any request to establish a legal relationship with The Institute or any of its affiliated or subsidiary companies accepts the transfer of his or her personal data, under the terms described in this Privacy Notice.
